承租人未依约合同履行的期限提前解除租赁合同退租的情况下，属于违约押金是否可以退还以及应该怎样退则要看租赁合同中对违约责任是怎样约定的，如果约定了违约不退押金的情况下，房东有权不退回押金如果合同中没有约定违约责任，则押金应当退还。

《中华人民共和国民法典》 第五百八十五条 当事人可以约定一方违约时应当根据违约情况向对方支付一定数额的违约金，也可以约定因违约产生的损失赔偿额的计算方法。
