释义	分居必须是连续，并且已满两年。分居的时间必须是连续不断的，如果分居期间又同居的，那么分居时间应该从同居后再分开的时间重新计算不能适用累加计算，即从夫妻因为感情不和而实际分居的第二日算起，到一方向人民法院提起离婚诉讼时为止，时间必须满两年法律依据：《中华人民共和国民法典》第一千零七十六条夫妻双方自愿离婚的，应当签订书面离婚协议，并亲自到婚姻登记机关申请离婚登记。离婚协议应当载明双方自愿离婚的意思表示和对子女抚养、财产以及债务处理等事项协商一致的意见。
