劳动合同两份都在公司是否合法
释义
法律分析：合同应该是合同当事人各执一份的，单位的做法不合法。劳动者除了到劳动部门投诉，要求取得一份劳动合同。如果发生劳动争议时，没有劳动合同，就说企业没有签定劳动合同，那样企业肯定就会拿出劳动合同的。
法律依据：《中华人民共和国劳动合同法》 第十六条 劳动合同由用人单位与劳动者协商一致，并经用人单位与劳动者在劳动合同文本上签字或者盖章生效。劳动合同文本由用人单位和劳动者各执一份。
