释义	法律分析：人民检察院对于公安机关移送审查起诉的案件,发现犯罪嫌疑人没有犯罪事实,或者符合刑事诉讼法第十五条规定的情形之一的,经检察长或者检察委员会决定,应当作出不起诉决定。对于犯罪事实并非犯罪嫌疑人所为,需要重新侦查的,应当在作出不起诉决定后书面说明理由,将案卷材料退回公安机关并建议公安机关重新侦查。法律依据：《中华人民共和国刑事诉讼法》第二百二十三条监狱和其他执行机关在刑罚执行中,如果认为判决有错误或者罪犯提出申诉,应当转请人民检察院或者原判人民法院处理。
