法律分析:
从实质要件上看，拘留与逮捕的条件差不太多，只是在程序上，拘留是由公安机关将需要逮捕的现行犯或者犯罪嫌疑人当即暂时剥夺人身自由。而逮捕需要经过检察院批准或人民法院决定，公安机关才能执行。
法律依据:
《中华人民共和国刑事诉讼法》 第八十七条 公安机关要求逮捕犯罪嫌疑人的时候，应当写出提请批准逮捕书，连同案卷材料、证据，一并移送同级人民检察院审查批准。必要的时候，人民检察院可以派人参加公安机关对于重大案件的讨论。
