释义	法律分析：1、本罪侵犯的客体是公共秩序。2、客观方面，聚众，是指纠集众人，是指由首要分子故意发动、纠集特定或不特定多数人于一定时间聚集于同一地点。淫乱，主要是指违反道德规范的性交行为，但除此之外，还应包括其他刺激、兴奋、满足性欲的行为。3、本罪的主体为一般主体。凡年满16周岁且具备刑事责任能力的自然人均能构成法律依据：《中华人民共和国刑法》第三百零一条聚众进行淫乱活动的，对首要分子或者多次参加的，处五年以下有期徒刑、拘役或者管制。
