快递丢失是赔给发件人还是收件人

赔偿一般是向寄件人赔偿，然后再由寄件人赔付给收件人。如果收件人没收到,快递员代收,导致丢失。那肯定快递公司要赔付的,另外还会快递员罚款。
法律依据：
《快递市场管理办法》 第七条 国务院邮政管理部门和省、自治区、直辖市邮政管理机构以及省级以下邮政管理机构（以下统称邮政管理部门）对快递市场实施监督管理，应当遵循公开、公平、公正以及鼓励竞争、促进发展的原则，规范快递服务，满足经济社会发展的需要。
邮政管理部门应当加强快递市场安全监督管理，维护寄递安全与信息安全。
