释义	法律分析：目前对鉴定人法律责任的确立方式是以机构责任为主，鉴定人(自然人)责任为辅。我国现行司法鉴定机构大多数是行政机构或机关事业单位举办的机构，主要确立的是刑事责任和国家赔偿责任，也有一些民事责任的规定。法律依据：《司法鉴定程序通则》第二十二条司法鉴定机构应当建立鉴定材料管理制度，严格监控鉴定材料的接收、保管、使用和退还。司法鉴定机构和司法鉴定人在鉴定过程中应当严格依照技术规范保管和使用鉴定材料，因严重不负责任造成鉴定材料损毁、遗失的，应当依法承担责任。
