释义	律师解答：无论是在婚前或婚后患病，经须久治不愈，如果患病时间短或者说能治好的情况下是不符合协议离婚条件的。必须对患有精神病的一方的生活问题做出安排，不能让其自生自灭，如精神病患者在离婚后，由其父母或有监护人照料或者在离婚后，仍有另一方给予照料，这样就可以离婚。【法律依据】：《中华人民共和国民法典》第一千零七十六条夫妻双方自愿离婚的，应当签订书面离婚协议，并亲自到婚姻登记机关申请离婚登记。离婚协议应当载明双方自愿离婚的意思表示和对子女抚养、财产以及债务处理等事项协商一致的意见。
