《中华人民共和国人民陪审员法》第五条公民担任人民陪审员，应当具备下列条件：（一）拥护中华人民共和国宪法；（二）年满二十八周岁；（三）遵纪守法、品行良好、公道正派；（四）具有正常履行职责的身体条件。担任人民陪审员，一般应当具有高中以上文化程度。
