越权订立的合同是否有效呢

首先，越权合同属效力待定的合同。一般是不生效的，这类合同一般须经有权人表示承认方能生效。
在订立合同的过程中，合同的相对人知道或者应当知道法定代理人或者其他组织的行为是超越了权限，而仍与之订立合同，则具有恶意,那么此时，合同就不具效力。
【法律依据】
《民法典》第五百零四，法人的法定代表人或者非法人组织的负责人超越权限订立的合同,除相对人知道或者应当知道其超越权限外，该代表行为有效,订立的合同对法人或者非法人组织发生效力。
