委托代理的法律后果由谁承担

法律分析：受委托人是以委托人名义行使委托义务的，依照委托人委托内容行事的法律后果由委托人承担;相反，受委托人超出委托内容行事的法律后果则具有可追认性 (即委托人承认的则由委托人承担，否则收委托人自己承担该法律后果)。
法律依据：《中华人民共和国民法典》 第一百六十二条 代理人在代理权限内，以被代理人名义实施的民事法律行为，对被代理人发生效力。
