释义	法律分析：夫妻双方无论分居多少年，不论是2年、5年、10年也好，均没有自动离婚的说法。重婚罪构成的情形有且只有两种：1、重复登记。顾名思义就是说在民政局登记有两段婚姻，且前一段婚姻还没办理离婚。2、以夫妻的名义共同生活。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
