释义	法律分析：如果对年幼的或者患病的孩童拒绝扶养，情节恶劣，则具有扶养义务的人就构成遗弃罪。但如果是仅仅对这些儿童出于教育的目的进行恐吓，采用饿肚子的方式，则不能认为是拒绝扶养，也不算情节恶劣，一般不应认定为犯罪。法律依据：《中华人民共和国未成年人保护法》第五十二条对未成年人负有扶养义务而拒绝扶养，情节恶劣的，依照刑法第一百八十三条的规定追究刑事责任。
