释义	离婚诉讼，是指婚姻关系当事人一方向法院提出与另一方解除婚姻关系的诉讼。起诉离婚不一定都会立案，起诉离婚需要向法院提交诉讼状，法院会对案件进行审查，符合条件的，法院就会对案件进行立案处理。法条依据：《中华人民共和国民事诉讼法》第一百二十三条：人民法院应当保障当事人依照法律规定享有的起诉权利。对符合本法第一百一十九条的起诉，必须受理。符合起诉条件的，应当在七日内立案，并通知当事人；不符合起诉条件的，应当在七日内作出裁定书，不予受理；原告对裁定不服的，可以提起上诉。
