释义	行政机关在作出行政决定，特别是行政处罚之前，应当履行告知义务。告知程序是行政处罚的必经程序。“告知”对于当事人来说，是其法定的权利；对于行政机关来说，是其法定的义务。如果行政机关未履行告知程序即作出行政处罚决定，就违反了《行政处罚法》的规定，其后果就是所作出的具体行政行为被撤销。【本文关联的相关法律依据】《行政处罚法》第三十一条规定，行政机关在作出行政处罚决定之前，应当告知当事人作出行政处罚决定的事实、理由及依据，并告知当事人依法享有的权利。
