释义	1、协议双方当事人应当是具有完全民事行为能力人。 2、订立同居财产协议必须出于双方自愿，任何一方均不能对另一方采取隐瞒、欺诈、胁迫的方式，也不能乘人之危。基于不真实的意思表示而订立的协议是无效的。 3、同居期间财产协议的对象必须是同居一方或者双方合法拥有的财产，不能处分属于其他人的财产，不属于同居双方所有的财产不能成为财产协议的客体。 4、同居财产协议的内容必须合法，既不能规避法律，也不能违反公序良俗。 5、在写同居财产协议时，要尽量对财产的形式等作详尽的约定，以便日后可操作性。
