释义	法律分析：撤诉就是撤回起诉，调解时在法院主持下原被告达成和解。二者都是在起诉受理后审理终结前。撤诉后可以在起诉，因为撤诉相当于撤回原来的诉，原来的诉不存在了。调解的话则不可以，因为原来的诉还在，按照“一事不再理”原则，法院不再受理。此种情况只能申请再审。法律依据：依据《民事诉讼法》第89条第3款规定，调解书经双方当事人签收后，就具有法律效力，其效力与判决相同
