释义	嫖娼违法，但一般不犯罪。一般的嫖娼行为在我国被认为是违反治管理的行为，违反了《治安管理处罚法》，属于违法行为，但尚未构成犯罪。通常根据《治案管理法》和《卖淫嫖娼管理办法》处罚。法律依据：《中华人民共和国治安管理处罚法》第六十六条卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款;情节较轻的，处五日以下拘留或者五百元以下罚款。在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。
