《关于民事诉讼证据的若干规定》 第六十八条 人民法院应当要求证人出庭作证，接受审判人员和当事人的询问。证人在审理前的准备阶段或者人民法院调查、询问等双方当事人在场时陈述证言的，视为出庭作证。双方当事人同意证人以其他方式作证并经人民法院准许的，证人可以不出庭作证。无正当理由未出庭的证人以书面等方式提供的证言，不得作为认定案件事实的根据。
