释义	法律分析：这种情况不能视为放弃继承，放弃继承必须有明确的意思表示，这种表示可以是书面的，也可以是口头的。但如果没有明确表示，即使不主动参加遗产分割，也不能视为放弃继承。法律依据：《中华人民共和国民法典》第一千一百二十四条继承开始后，继承人放弃继承的，应当在遗产处理前，以书面形式作出放弃继承的表示;没有表示的，视为接受继承。受遗赠人应当在知道受遗赠后六十日内，作出接受或者放弃受遗赠的表示;到期没有表示的，视为放弃受遗赠。
