释义	强奸罪，是指违背妇女意志，使用暴力、胁迫或者其他手段,强行与妇女发生性交的行为，或者故意与不满14周岁的幼女发生性关系的行为。被实施对象为女性，女性强行和男性发生性关系不构成强奸罪。但是女性强奸男性构成强制猥亵罪。法律依据：《中华人民共和国刑法》第二百三十七条以暴力、胁迫或者其他方法强制猥亵他人或者侮辱猥亵妇女的处以5年以下有期徒刑或者拘役;聚众或者在公共场所当众犯前款罪的，处5年以上有期徒刑;猥亵儿童的，依照两款的规定从重处罚。
