释义	买小产权房不能更名，因为没有房产证。一、所谓“小产权”是指在农民集体土地上建设的房屋，未缴纳土地出让金等费用，其产权证不是由国家房管部门颁发，而是由乡政府或村政府颁发，所以叫做“乡产权”，又叫“小产权”。二、乡镇政府发证的所谓小产权房产，实际上没有真正的产权。这种房没有国家发的土地使用证和预售许可证，购房合同国土房管局也不会给予备案。所谓产权证也不是真正合法有效的产权证。三、如果该小产权房所在的集体土地归属的行政村居民之间是可以相互转让的，如果是外村户口的居民是不能购买这样的小产权房的。
