二审中撤回起诉的后果？

二审撤回的只是上诉而不是起诉，民事诉讼二审中撤诉的法律后果直接是一审裁决生效,双方需要执行一审判决。
在二审程序中，原告撤诉后是不能提请再诉的，所以一定要谨慎使用撤诉权。
