释义	建筑工程发包人是指具有工程发包主体资格和支付工程价款能力的当事人以及取得该当事人资格的合法继承人。发包人有时称发包单位、建设单位(《建筑法》)或业主、项目法人。【法律依据】《建筑法》第十五条，建筑工程的发包单位与承包单位应当依法订立书面合同，明确双方的权利和义务。发包单位和承包单位应当全面履行合同约定的义务。不按照合同约定履行义务的，依法承担违约责任。
