释义	法律分析：当事人在签订合同时，一般都会约定合同争议解决方式。一旦协商不成引发诉讼纠纷，合同中的管辖条款往往是“兵家”必争之地，诉讼成本、地区差异性等因素，都影响案件进程甚至案件结果。在实务案件中，对于合同中涉及或裁或审条款的约定，通常情况下法院会认定该仲裁条款约定无效，案件由法院进行管辖。法律依据：《最高人民法院关于适用若干问题的解释》第七条当事人约定争议可以向仲裁机构申请仲裁也可以向人民法院起诉的，仲裁协议无效。
