释义	法律分析：债务加入的法律依据，对债权人的效力。债务加入关系中存在两个相互依存的债权债务关系，其法律效果是使债权人的债权进一步得到保障，故债权人可以向原债务人主张权利，同时也可以向第三人主张清偿。另一方面，债务加入中两个债务互相排斥，债权人仅享有一个债权，故第三人及原债务人中的任何一方履行了清偿义务，债权人的债权即归于消灭。法律依据：《中华人民共和国民法典》第七百零一条保证人可以主张债务人对债权人的抗辩。债务人放弃抗辩的，保证人仍有权向债权人主张抗辩。
