法律主观：
第一、同申请行政复议的具体行政行为有利害关系；这种利害关系可以是直接，也可以是间接的。例如：某村民向镇政府申请建房，虚报多报户口，瞒报少报已有 宅基地 ，镇政府工作人员未认真核查，发给其建房许可证，该村民开始建房，后经县土地管理局查明，对该村民给予 行政处罚 要求其退还非法地，并处以罚款，该村民不服提起行政复议，这里镇政府就是以第三人的名义参加复议，因为镇政府与这一具体行政行为有直接利害关系。再如，某甲经工商局批准在一繁华地段摆摊售货，而某乙以某甲摆摊为由，对工商局不批准其在该地段摆摊，向上一级工商局提起行政复议，这里某甲与这个不批准摆摊的具体行政行为之间，有间接的利害关系。因此，某甲也是以第三人的身份参与这个行政复议。 第二、第三人参与到复议中间来，一定是在复议申请已经受理，复议活动尚未终结的时候，如果行政复议还未开始或者已经终结，都不会再第三人的问题。 第三、符合前两个条件，要想参加行政复议，成为第三人，还要经过行政复议机关的批准，这是为了一方面要保护第三人的合法权益，同时也要保护复议申请人的合法权益，防止不必要的干扰行政复议活动的情况发生。
