民事诉讼中的自认 法律问题
释义
法律分析:
自认是指当事人对不利于自己事实的承认。它分为诉讼中的自认和诉讼外的自认。诉讼中的自认是指当事人在诉讼过程中对另一方当事人陈述的不利于自己的案件事实的承认。
法律依据:
《最高人民法院关于民事诉讼证据的若干规定》 第五条 当事人委托诉讼代理人参加诉讼的，除授权委托书明确排除的事项外，诉讼代理人的自认视为当事人的自认。
当事人在场对诉讼代理人的自认明确否认的，不视为自认。
