释义	只要是无效的婚姻，自始不具有法律效力，当事人之间也不具有夫妻之间的权利和义务，应当予以解除。根据法律规定，当事人可以搜集婚姻无效的证据向人民法院请求确认婚姻无效。人民法院受理离婚案件后，经审理确属无效婚姻的，应当将婚姻无效的情形告知当事人，并依法作出确认婚姻无效的判决。婚姻被确认无效时，该婚姻自始没有法律约束力，当事人不具有夫妻的权利和义务。法律依据《中华人民共和国民法典》第一千零五十四条最高人民法院关于适用《中华人民共和国民法典》婚姻家庭编的解释(一)第十二条、第二十条
