释义	根据《刑法》第141条的规定，生产、销售假药罪，是指生产者、销售者违反国家药品管理法规，生产、销售假药，足以危害人体健康的行为。根据刑法修正案八的规定，只要具有主观故意生产、销售假药的行为，即构成本罪。生产、销售的假药具有下列情形之一的，应当立案：1、含有超标准的有毒有害物质的;2、不含所标明的有效成份，可能贻误诊治的;3、标明的适应症或者功能主治超出规定范围，可能造成贻误诊治的;4、缺乏所标明的急救必需的有效成份的。
