交完养老保险人去世了怎么办 |

法律分析：如果养老保险还没交够十五年但是人死亡了，之前个人所缴纳的养老保险金会全部退回，但是如果是单位交的就不会退回。此刻，参保者缴纳的钱原封不动的在个人养老账户中，一分钱都还没领取就离世了。这笔钱可以当作遗产，合法继承人可依照规定将这笔钱直接取出来。如果养老保险交够了十五年但还没来得及领养老金就人就死亡了，个人缴纳的养老保险会全部退回给家属。这种情况跟上述情况相似，参保者缴纳的钱原封不动的在个人养老账户中，虽然已经缴满十五年，在退休后可以领取养老金了，但是因为还没有退休或别的原因，并没有开始领取，个人缴纳的养老保险是可以退回给家属的。根据养老保险的养恤金标准，个人账户养老金将在139个月内发放。若在发放期内，参保者离世，个人账户中的余额可以由合法继承人继承。领取了139个月的养老金后，个人养老账户此刻余额为零，参保者依旧可以继续领取养老金，不过这笔钱开始由国家出资。此时，参保者离世，继承人将不再有继承养老账户金额的权利，该账户将作销号处理。

第四条 中华人民共和国境内的用人单位和个人依法缴纳社会保险费，有权查询缴费记录、个人权益记录，要求社会保险经办机构提供社会保险咨询等相关服务。个人依法享受社会保险待遇，有权监督本单位为其缴费情况。
第五十七条 用人单位应当自成立之日起三十日内凭营业执照、登记证书或者单位印章；向当地社会保险经办机构申请办理社会保险登记。社会保险经办机构应当自收到申请之日起十五日内予以审核，发给社会保险登记证件。
