问题	什么是协议离婚？
释义	协议离婚，是指夫妻双方自愿离异，并就离婚的法律后果如财产分割和子女抚养等问题达成协议，经过国家婚姻登记部门的认可来解除婚姻关系的离婚方式。在婚姻法学理论中，又将协议离婚的法律程序称为登记离婚，由国家主管婚姻登记的部门依法对双方的离婚请求进行审查和登记。我国的协议离婚由《婚姻登记条例》来规范，男女双方的协议离婚，应当经婚姻登记机关办理，属于行政登记管理程序。《婚姻登记条例》第十条规定，“内地居民自愿离婚的，男女双方应当共同到一方当事人常住户口所在地的婚姻登记机关办理离婚登记。”
