家庭暴力的构成要件的主客观要求有：
1、夫妻一方具有实施家庭暴力的主观故意；
2、实施了殴打、捆绑、残害、强行限制人身自由或其他手段，造成家庭成员的身体、精神等方面造成伤害的行为；
3、造成了一定的伤害的后果；
4、伤害后果和施暴者实施的行为之间具有因果关系。
家庭暴力的行为人都具有直接故意，即行为人有意识、有目的地对被害人进行肉体上或精神上的折磨和摧残。

二、家暴轻微伤起诉离婚是否可以离婚
1、家暴轻微伤起诉离婚是可以的。这是法定的调解无效可判决离婚的情形。“家庭暴力”是指“行为人以殴打、捆绑、残害、强行限制人身自由或者其他手段给其家庭成员的身体、精神等方面造成一定的伤害后果的行为。凡是遭遇家庭暴力的，是可以离婚的。
2、法律依据：《民法典》第一千零七十九条夫妻一方要求离婚的，可以由有关组织进行调解或者直接向人民法院提起离婚诉讼。人民法院审理离婚案件，应当进行调解；如果感情确已破裂，调解无效的，应当准予离婚。有下列情形之一，调解无效的，应当准予离婚：
（一）重婚或者与他人同居；
（二）实施家庭暴力或者虐待、遗弃家庭成员；
（三）有赌博、吸毒等恶习屡教不改；
（四）因感情不和分居满二年；
（五）其他导致夫妻感情破裂的情形。
