释义	法律分析：无罪推定。法律依据：《中华人民共和国刑事诉讼法》第十二条没经人民检察院依规裁定，对所有人都不可明确犯法。第一百九十五条在被告最终阐述后，法官公布休庭，仲裁庭开展评定，依据早已查清的客观事实、直接证据和相关的法律法规，各自作出下列裁定：（一）案子证据确凿，直接证据的确、充足，根据法律法规评定被告犯法的，理应做出犯法裁定；（二）根据法律法规评定被告没罪的，理应作出无罪判决；（三）无证据，不可以评定被告犯法的，理应做出无证据、控告的违法犯罪不可以创立的无罪判决。
