释义	法律分析: 一般贷款纠纷是一种民事法律关系，应受民事法律调整，不产生刑事责任。但是，如果行为人以贷款为名，行诈骗财物之实，则应以诈骗罪论处。而区分以贷款为名的诈骗罪与贷款纠纷的界限，最关键的是查明行为人有无非法占有他人财物的目的。法律依据: 《中华人民共和国民法典》第六百八十条禁止高利放贷，借款的利率不得违反国家有关规定。第五百七十四条借款期间不满一年的，应当在返还借款时一并支付，借款期间一年以上的，应当在每届满一年时支付，剩余期间不满一年的，应当在返还借款时一并支付。
