释义	法律分析：在同一物之上既存在物权又存在债权时，无沦其成立次序先后，物权优先于债权。物权优先于债权的法理根据主要在于《民法典》的公示公信原则，不动产经过登记或动产经过交付转移了占有，就发生物权转移，产生对抗第三人的债权的效力。如未经过登记或交付，就还停留在债权阶段，债权当事人之间地位平等，彼此不发生某一债权优先于其他债权的问题。法律依据：《中华人民共和国民法典》第二百零八条不动产物权的设立、变更、转让和消灭，应当依照法律规定登记。动产物权的设立和转让，应当依照法律规定交付。
