法律分析：
抚恤金是不能继承的，而是近亲属共有。也就是说每一个家属成员其实都可以使用这笔钱，但是往往会交于死者的配偶分配。死亡抚恤金是死者所在单位等给予死者近亲属和被扶养人的生活补助费。死亡抚恤金还含有一定精神抚慰的内容。死亡抚恤金发生于死者死亡后，所以不属于遗产

《中华人民共和国民法典》 第一千一百二十二条 遗产是自然人死亡时遗留的个人合法财产。依照法律规定或者根据其性质不得继承的遗产，不得继承。
