释义	公有住房的承租人对该房屋只享有使用权，而不具有所有权。所以在其死亡后，原有的房屋租赁关系已消灭，其继承人不能以继承的方式成为房屋租赁合同中的承租人。但作为承租人的家庭成员有优先承租该公房的权利。《城市公有房屋管理规定》第二十八条规定，承租住宅用房的，承租人在租赁期限内死亡，其共同居住两年以上的家庭成员愿意继续履行原契约的，可以办理更名手续。
