释义	不构成犯罪。所谓“不能抗拒”的原因，是指危害结果的发生，是行为人不可能阻挡或不可能控制的原因造成的，此时不能要求行为人对危害结果负刑事责任。所谓“不能预见”的原因，是指危害结果的发生不以行为人的主观意志为转移，是行为人无法预料的原因而造成的，此时也不能要求行为人对危害结果负刑事责任。法条根据：《中华人民共和国刑法》第十六条行为在客观上虽然造成了损害结果，但是不是出于故意或者过失，而是由于不能抗拒或者不能预见的原因所引起的，不是犯罪。该内容由陈亚楠律师和点行律询共创回答
