释义	保证是指保证人和债权人约定，当债务人不履行债务时，保证人按照约定履行债务或者承担责任的行为，也就说说，保证人作保证时，是以个人信用为债务人作担保；而担保人是指债务人或第三人和债权人约定以某财产作为担保，当债务人不履行债务时，债权人有权以该财产折价或者以拍卖、变卖该财产的价款中优先受偿的行为，也就是说，担保是以设定物作担保的。《民法典》第六百八十六条保证的方式包括一般保证和连带责任保证。当事人在保证合同中对保证方式没有约定或者约定不明确的，按照一般保证承担保证责任。
