释义	近日，国家工商行政管理总局收到各地发来的函电，请示服务商标被许可使用人如何执行《商标法》第四十条第二款的规定。经研究，提出如下意见：依照《商标法》第四条第三款的规定，《商标法》第四十条第二款的规定应适用于服务商标。尽管服务所具有的无形特性，使得服务商标被许可使用人无法直接在其提供的服务上标明其名称及地址；但服务商标被许可使用人应当以其他适当方式让消费者了解其名称及地址，如在其服务提供场所的显著位置标明，在其提供服务的工具上标明，在交付消费者的商业文书上标明等，以履行此项义务。
