公司商标抢注能撤销，商标法对撤销申请有5年的限制规定，即如果商标获得注册时间超过5年的，就不可以以被抢注为由进行撤销。就相同或者类似商品申请注册的商标是复制、摹仿或者翻译他人未在中国注册的驰名商标，容易导致混淆的，都可以申请撤销。【法律依据】《最高人民法院关于审理商标民事纠纷案件适用法律若干问题的解释》，侵犯注册商标专用权的诉讼时效为二年，自商标注册人或者利害权利人知道或者应当知道侵权行为之日起计算。
