释义	死亡抚恤金不是遗产，这是被继承人死亡后，对被继承人的亲属给予的一种精神上的抚慰金。也就是说，抚恤金发放的对象是被继承人的亲属，而不是被继承人。也就是说，死亡抚恤金不属于被继承人的遗产，故被继承人无权支配其归属。因此死亡抚恤金不能继承。《中华人民共和国民法典》第一千一百二十二条遗产是自然人死亡时遗留的个人合法财产。依照法律规定或者根据其性质不得继承的遗产，不得继承。
