释义	法律分析: 被通知的继承人不愿意参加诉讼又未明确表示放弃实体权利的，人民法院仍应把其列为共同原告。法律依据: 《最高人民法院关于贯彻执行若干问题的意见》第四十七条继承人放弃继承权应当以书面形式向其他继承人表示。用口头方式放弃继承，本人承认，或有其它证据证明的，也应当认定其有效。第四十八条在诉讼中，继承人向人民法院以口头方式表示放弃继承的，要制作笔录，由放弃继承的人签名。
