释义	法律分析：诈骗是犯罪，不论是国家公职人员还是其它人员，犯罪都应追究刑责。这不属于违纪。法律依据：《中华人民共和国民法通则》第五十八条一方以欺诈、胁迫手段或乘人之危，使对方在违背真实意思的情况下所为，为无效的民事行为。合同法第五十四条也重申：一方以欺诈、胁迫的手段或乘人之危，使对方在违背真实意思的情况下订立的合同，受损害方有权请求人民法院或者仲裁机构变更或者撤销。
