释义	法律分析：私自破坏他人祖籍坟山，没有动死者尸体的，一般情况下是不构成犯罪的。但违反了治安处罚法，会被公安机关拘留、罚款的。法律依据：《中华人民共和国治安管理处罚法》第六十五条有下列行为之一的，处五日以上十日以下拘留；情节严重的，处十日以上十五日以下拘留，可以并处一千元以下罚款：（一）故意破坏、污损他人坟墓或者毁坏、丢弃他人尸骨、骨灰的；（二）在公共场所停放尸体或者因停放尸体影响他人正常生活、工作秩序，不听劝阻的。
