问题	婚后一方不知情的债务怎么处理
释义	实践中并不以夫妻一方是否知道债务的存在而承担责任，而是看该笔债务是否属于共同债务，包括是否为了共同生活或婚姻关系存续期间，是否为履行法定义务所负债。如果认定属于夫妻共同债务，即使一方不知情，那么也是要承担责任的，也就是具有归还的义务。但要是认定为夫妻个人债务的，那么不管另一方是否知道，此时都是不需要承担法律责任的。法律依据《最高人民法院关于审理涉及夫妻债务纠纷案件适用法律有关问题的解释》第一条、第三条《关于人民法院审理离婚案件处理财产分割问题的若干具体意见》第17、18
