释义	法律分析：犯罪故意的认定为：犯罪故意是指明知自己的行为会产生触犯刑法、危害社会的后果，仍然希望或者放任这种结果发生的心理状态。故意的成立包含两个因素：1、认识因素，是指对所有犯罪事实完全知道，如果没有认识到所有犯罪的客观事实事实，就不可能成立故意；2、意志因素，表明犯罪行为人对法律感召的态度。法律依据：《中华人民共和国刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
