法律分析：劳动法规定工作一般时间是不超过八小时。平均每周工作时间不超过四十小时的工时制度。法定工作时间就是按照国家法律明文规定的，劳动者最多工作的时间；国家实行劳动者从全年日历时间365天中扣除52个星期的公休日104天，扣除法定节假日11天，全年应工作250天，每月平均工作20.83天，每天工作8小时。
